Terms and Conditions of Use

These Terms and Conditions (“Terms”) govern your access to and use of the William James Scaffolding App (the “App”), operated by William James Scaffolding Ltd (“we”, “us”, “our”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Purpose of the App

The App is provided for internal business and operational use, including but not limited to:

• Job management and tracking
• Quoting and estimates
• Uploading photographs and documents
• Internal forms, inspections, and records
• Integration with third‑party services (e.g. accounting software)

The App is not intended for consumer use.

3. Eligibility and User Accounts

• The App may only be used by authorised employees, subcontractors, or representatives of William James Scaffolding Ltd.
• You must provide accurate and complete information when creating or using an account.
• You are responsible for maintaining the confidentiality of your login details.
• You must notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts at our discretion.

4. Acceptable Use

You agree that you will:

• Use the App only for lawful business purposes
• Comply with all applicable UK laws and regulations
• Not misuse, interfere with, or disrupt the App
• Not upload false, misleading, or unlawful content
• Not attempt to gain unauthorised access to systems or data

You must not:

• Reverse engineer, copy, or resell the App
• Use the App to transmit malware or harmful code
• Use the App in a way that could damage our business or reputation

5. Data and Content

5.1 User‑Generated Content

You retain ownership of any content you upload to the App (including photographs, documents, and text). By uploading content, you grant us a non‑exclusive, royalty‑free licence to store, process, and use that content solely for business and operational purposes.

You confirm that you have the right to upload any content provided.

5.2 Data Accuracy

While the App is designed to assist business operations, you remain responsible for verifying the accuracy of all data entered, including measurements, quantities, prices, inspections, and safety records.

6. Data Protection and Privacy

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR)and the Data Protection Act 2018.

Details of how we collect, store, and use personal data are set out in our Privacy Policy, which forms part of these Terms.

7. Third‑Party Services

The App may integrate with third‑party services (such as Xero or cloud storage providers). We are not responsible for the availability, accuracy, or performance of third‑party services, and your use of them is subject to their own terms and conditions.

8. Intellectual Property

All intellectual property rights in the App, including software, design, logos, and branding, belong to William James Scaffolding Ltd or its licensors.

Nothing in these Terms grants you any ownership rights in the App.

9. Availability and Changes

• We do not guarantee that the App will be available at all times or error‑free.
• We may update, modify, suspend, or discontinue the App (or any part of it) at any time.
• We may update these Terms from time to time. Continued use of the App constitutes acceptance of updated Terms.

10. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided on an “as is” and “as available” basis.
• We shall not be liable for any indirect, consequential, or economic loss, including loss of profit, data, or business opportunity.
• We are not responsible for decisions made or actions taken based on information generated or stored in the App.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

11. Indemnity

You agree to indemnify and hold harmless William James Scaffolding Ltd against any claims, losses, or damages arising from your misuse of the App or breach of these Terms.

12. Termination

We may suspend or terminate your access to the App immediately if:

• You breach these Terms
• Your access is no longer required for business purposes
• We reasonably believe there is a security or legal risk

Upon termination, your right to use the App will cease immediately.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
